TERMS S CONDITIONS
1.General
The Following terms and conditions apply to all orders placedby the customer (hereinafter referred to as "you” or"Customer")with Cooper Advertising GmbH, hereinafterreferred to as “O∩-FAME","us "or "we", at the On-FAME.com website, mobile website, or telephone (jointlyreferred to as "On-FAME.com").
Please make sure you have read and understood the Termsbefore placing your order, A prerequisite Por starting to usethe Store and placing orders is reading and accepting theseRegulations.
The inclusion of any products or services on On-FAME.COmat a particular time does not imply or warrant that theseproducts or services will be available at any time. wereserve the right to discontinue any product at any time.
Customers registering in the Store and making purchasesthere provide their personal data and consent to itsprocessing by Cooper Advertising GmbH under the terms ofthe Privacy Policy.
The Customers have the opportunity to use the Store byregistering and thus creating a private account(hereinafter referred to as "Customer Account"), in whichpersonal data and information about the Customer relatingto his/her orders placed in the Store are collected andwithout registering.The Customer has the right toterminate the agreement concluded with the Sellerconcerning the Customer Account at any time by submittingto the Seller a declaration of intent to delete the CustomerAccount.For this purpose, the Customer should contact theSeller or use the Punctions provided in the CustomerAccount
The Customer shall be liable for providing false personaldata. The $eller reserves the right to refuse to process andcancel a product order in a situation where the Customerhas provided Palse data or where the data raisesreasonable doubts of the $eller as to its correctness. In sucha case, the Customer will be informed by phone or e-mailabout the reasons for cancellation of the order. in such asituation, the Customer has the right to explain allcircumstances relabed to the verification of the veracity ofthe data provided and the cancellation of the order. in theabsence of data allowing the Store to make contact withthe Customer, the $tore will provide any explanations afterthe Customer has made contact,
The customer is responsible for all transactions that werecarried out using the login and password, unless the login orpassword inPormation was disclosed to a third partythrough no fault of the customer. The store undertakes tomake every ePPort to protect the login and password fromdisclosure. The customer undertakes to make every effortto protect the login and password Prom disclosure tounauthorized third parties
The store is not responsible for the transfer by theCustomer of its login or password to the Customer'sAccount to third parties. In case of expiration, change ordeletion of the e-mail account provided by the Customer atthe time of registration of the Customer Account, theCustomer should inPorm the Store.
The Customer declares that all data provided by him/herFor the purpose of processing the order are true, while theStore is not obliged to verify their veracity and correctness
0n-FAME wants to provide the best possible onlineexperience. To make this possible we need to ensure thatour services run like clockwork. We reserve the right toimmediately bar access bo the site and close the account ofany user who violates this provision or any other provision inthese terms and conditions.

Use of the store is not permitted for persons undereighteen (18)years of age (or the age of majority in ePfectin your country).
2.Prices and delivery charges
The prices displayed at On-FAmE.com include the statutoryValue Added Tax For European Union countries, but do notinclude import duties, fees and taxes upon delivery for thirdcounbries.
Transportation cost is also not included and will beconfirmed at the checkout page
3.Ordering/conclusion of contract
The ordering options available to you are via O-FAME.com
Once you have placed your order, if you have supplied uswith your email address, you will receive an emailconfirmation.If for any reason we are unable to fulfill yourorder, we will let you know at the earliest opportunity.if wehave already received payment for such an order, we willattempt to refund the applicable amount using the samemethod used to make the payment. lf, for any reason,alternative arrangements are necessary we will notify youand ask you to contact On-FAME Customer Service who willsettle the rePund.
4.Pre-order
1.0n-FAME reserves the right to introduce special oPPerssuch as .pre-order"/"waiting list" under which thecustomer will be able to purchase goods Prom newcollections,even before the date of launching thecollection Por regular sale.
2. By placing a pre-order you agree to be bound by theseterms For pre-order of goods and the ordinary Termsand Conditions.
3.when placing a pre-order your contact inPormationmust be accurate and kept updated. if we do not haveaccurate or updated contact information we will notbe able to keep you informed of your pre-order.
4. when you place a pre-order you will need to pay thePull price Por the products ordered and any applicabledelivery Pees.
5.Pre-ordered products will be shipped as soon aspossible,subject to availability. Please note that launchdates and dates of availability of products are subjectto change and we are not liable for any changes osuch dates.
5.Delivery
0n-FAME exercises the utmost diligence in accepting andprocessing orders and will endeavor to deliver your order inaccordance with your selected delivery option, but no laterthan 30 days after payment of the order.
Before you place your order, you will be informed of theexpected delivery details and cost. Once you have placedyour order you will receive an email confirmation with yourexpected delivery details. Once the order is confirmed andpacked at our warehouse you will receive a tracking numberPor your consignment.
Please note that you are responsible for accepting thedelivery once the parcel is shipped.
If you rePuse the delivery or cover the charges resultingFrom your country's domestic tax policy or importregulations, we will deduct the cost of returning the parcelProm your rePund. Deducted costs consist of duty paid byUPS/ DHL in advance and returning the parcel.
6.Customs Duties 8 Taxes
All countries within the European Union have Valve AddedTox included in the final price.
Please note that all recipients outside the EEA(TheEuropean Economic Area) are responsible for duties andtaxes. The shipping service, upon delivery, wil collect thesecharges. Please check with your country's customs ofPice todetermine these costs.
7.Returns
You can return any item to us within 14 days of receivingyour original order, including sale items. Remember that themerchandise must be unworn and unwashed with all the On-FAME tags attached. we do not accept exchanges onreturned items, but you can send them back For a refundand then place a new order Por the size, color or item you'dprefer. Please note -duties, taxes and the original shippingcharges are non-refundable. As an international customer,you can return your parcel using any postal service. Pleasenote-you will need to cover the shipping costs yourself
If the item you have received is defective, please notify On-FAME promptly and return the item to the address asbelow. On-FAME will, for any products deemed dePective.provide a new product or a full refund, including the costsof delivery.

The parcel remains your responsibility until it arrives to usremember to ask For a sending receipt, so if your parcelgoes missing in the mail, you'll have proof you have sent it.When you return your order, please remember to put yourreturns note (which you can download here) in the parcel. ltcan usually take up to 21 working days for your return to bedelivered back to us in Poland, depending on your locationand which postal service you use. Once we receive yourreturn we will make the refund via the original paymentmethod within 10 working days.
8.Payment methods
We generally accept the Pollowing payment methods:credit/debit card payment, Klarna and Sofort. We reservethe right not to accept certain payment methods for agiven order and to refer to other payment methods
Credit card or Payment card
You can enter your payment details at the time you placeyour order using a valid credit or payment card. Theapplicable amount will immediately be reserved on yourcredit/payment card but will not be debited until the goodsare dispatched. Please note that applicable bank chargeswill be borne by you.
You will receive the legally required invoice in your parcel
9.Our Liability
Our maximum liability to you for any loss or damage arisingin connection with your order on On-FAME.com shall belimited to the total price of your order.
10.$tatutory right of revocation and $tatutory liability Pordefects-EU CUSTOMERS.
This clause only applies to customers based in the EU andwho wish to cancel a Contract under the ConsumerContracts Regulations.
You have a statutory right of revocation.
Information regarding the right of revocation:
You have the right to revoke this contract within 14 dayswithout giving any reasons. The period of revocation is 14days From the day on which you, or a third partydesignated by you (but who is not the carrier), tookpossession of the last item of merchandise. In order toexercise your right of revocation you must notiPy us of your
decision to revoke the contract by sending us anunequivocal declaration (e.g. a letter sent by post or an e-mail).lf you wish, you may use the attached revocationForm, but there is no requirement to do so. You may alsocomplete and submit the revocation Porm or otherunequivocal declaration online through the contact form onour website. lf you submit your notice of revocation onlinewe will send you a confirmation of receipt without unduedelay (e.g. by e-mail). You will be deemed to have compliedwith the revocation period if you send your notice ofrevocation before such period expires
Conseqvences ofrevocation
If you revoke this contract, we are reguired to refund alpayments we received From you, including delivery costs(except any additional costs incurred as a result of youchoosing a delivery method other than the lowest-coststandard delivery ofPered by us), without undue delay andat least within 14 days from the day on which we receivedyour notice of revocation of this contract. Refunds will beprocessed using the same method of payment which youused Por the original transaction, unless expressly agreedotherwise with you. we will not charge you any fees for therePund. we may hold off completing your refund until wehave received the merchandise back, or you have suppliedus with proof that you have returned the merchandise,whichever occurs earlier. You are obliged to return or handover all merchandise to us without undue delay, but at leastwithin 14 days from the day on which you gave us yournotice of revocation of this contract. The aboverequirement is deemed satisfied if you return the goodsbePore expiry of the 14-day period. You are only obliged tocover any depreciation in the value of merchandise if thedepreciation is attributable to your improper handling ofthe merchandise when examining its condition, propertiesand Punction.
The right of cancellation expires prematurely for contractssubject to sealed goods which have been unsealed afterdelivery and which are not suitable for return due tohygienic reasons.
Products ofPered in the $tore are brand new and originalThe $eller shall be liable to the consumer for any lack ofconPormity with the contract existing at the time ofdelivery of the goods and which has become apparentwithin two years from that time.
In case of non-conformity with the contract, the consumerhas the right to demand that the goods be brought intoconPormity with the contract, to receive a proportionateprice reduction or to terminate the contract.To bring the goods into conformity with the contract, theconsumer may choose between repair and replacement,unless the chosen remedy would be impossible or, comparedto another remedy, would involve disproportionate costs forthe seller, taking into account all the circumstances of thecase To 汆bring the goods into conformity with the contract.the consumer may choose between repair and replacementunless the chosen remedy would be impossible or, comparedto another remedy, would involve disproportionate costs forthe seller, baking into account all the circumstances of thecase, including:

The consumer does not have the right to terminate thecontract if the non-conformity is only insignificant
The consumer has the right to withhold payment of theremainder of the price or part thereof until the seller hasPulPilled its obligations under the above.
The relevant statutory provisions govern our liability fordefects.
If you have a complaint, please contact us. lf you feel yourcomplaint is not adequately addressed you can - but arenot obliged to -use the Online Dispute Resolution(ODR)platform that you can access Ehroughhttp://ec.europa.eu/odr.
11.Guarantee
If there are defects in the goods you have purchased, On-FAME abides by all statutory guarantee regulations. if youhave a complaint regarding obvious material ormanuPacturing faults in goods that we have supplied.including damage incurred in transit, please let us know byreturning the goods to us without delay by using theprovided pre-printed return Porm.
12.$everance
If any part of these Terms is disallowed or Pound to beinefPective by any court or regulator, the other Terms shallcontinue to apply.
13.Ounership of rights
All intellectual property rights, such as brademarks andcopyrights at On-FAME.com remain with Cooper AdvertisingGmbH and its subsidiaries or licensors. Any use of On-FAME.com or its contents, including copying or storing suchcontent in whole or part, other than for your own personalnon-commercial use, is prohibited without the permission ofOA-FAME.

15.Final Provisions
Polish law applies to the contract of sale of products in thestore, Any dispute arising out of or relating to these Termsand Conditions or any non-contractual obligations arisingout of or relating to these Terms and Conditions shall besubmitted to the exclusive iurisdiction of the courts ofPoland or the jurisdiction of the courts of your place ofresidence, if so provided by applicable law.
These Regulations do not exclude and do not limit any rightsof the Customer who is a Consumer, which he is entitled tounder the mandatory provisions of law. in the event of acontradiction between the provisions of these Regulationsand the mandatory provisions of law granting broaderrights to Consumers, these provisions shall prevail.
0n-FAME reserves the right to amend the provisions ofthese Regulations for important reasons, in particular:(a)in order to adapt them to generally applicable laws.
b)in order to eliminate possible provisions that may violatethe interests of Customers,
c)in connection with a change or expansion of the range ofservices and goods provided by the Store,
d)in connection with a change, limitation or expansion ofthe business profile of On-FAME.
e)in connection with organizational changes on the part ofOA-FAME.
The changes referred to in paragraph 2 are not binding onCustomers who have placed an order prior to theintroduction of the changes in the terms and conditionsbelow, unless the changes result Prom mandatory provisionsof law. The Customer will be notified of any change in theTerms and Conditions to the e-mail address indicated whenplacing the order
If changes are made to the Terms and Conditions, the Storewill inform Customers of the new content of the Terms andConditions electronically (to the e-mail addresses indicatedin the Customer Account or when placing orders) and bypublishing the new Terms and Conditions on the Store'swebsite, at least 14 daus before the new Terms andConditions come into efPect.if the Customer does notaccept the content of the new Regulations, he/she has theright to terminate the contract concluded with O∩-FAMEregarding the Customer Account at any time by submittinga declaration of intent to delete the Customer Account.The Regulations shall come into force on 6 $eptember 2022Orders placed by the Customer before the ePPective dateof the new Regulations will be processed on the basis of theexisting Regulations accepted by the Customer on the dateof order placement.
In the event that any of the provisions of these Terms andConditions is amended or invalidated, as a result of a finalcourt decision, the remaining provisions of these Terms andConditions shall remain in Porce and bind the parties.
Please be inPormed that any comments and suggestionsProm Customers are always welcome and desirable Prom thepoint of view of On-FAME's policy, the main objective oPwhich is to act in the interests of the Store's Customers. Inorder to send comments and suggestions, or if theCustomer believes that his or her rights have been violated,or if the national laws applicable to the Customer grant himor her greater legal protection than the provisions of theseterms and conditions, please use the contact form or sendinformation to the e-mail address: info@On-FAME.com. TheStore will then try to bake his suggestion into account as faras possible and grant protection to his rights.
The Client can decide to access to the platform foralternative extra-judicial resolution of disputes provided bythe European Commission, available on the websitehttp://ec.europa.eu/odr.
